Course Overview

This comprehensive two-day program equips correctional staff with essential knowledge about legal frameworks, institutional responsibilities, and liability risks inherent to correctional operations. Participants will develop practical competency in legal terminology, lawsuit procedures, and how institutional practices—or failures in practice—can generate legal exposure for both individual employees and facilities.

Day One: Intake, Classification, and Medical Considerations

The first day concentrates on critical intake and classification procedures, encompassing:

  • Medical, dental, and mental-health screening protocols
  • Suicide-risk assessment and prevention strategies
  • Medication-assisted treatment (MAT), opioid use disorder (OUD), and medication for opioid use disorder (MOUD) management with attention to continuity of care
  • Americans with Disabilities Act (ADA) compliance and accommodations
  • Prison Rape Elimination Act (PREA) requirements
  • Protective custody decisions and procedures
  • Appropriate housing assignments based on assessment findings

Special attention is given to the critical importance of identifying, documenting, and responding appropriately to information gathered during the intake and classification phase.

Day Two: Confinement Conditions, Staff Conduct, and Grievance Procedures

The second day addresses legal obligations related to conditions of confinement and employee responsibilities, including:

  • Sanitation, nutrition, and medical care standards
  • Religious meal accommodations and religious freedom protections under the Religious Land Use and Institutionalized Persons Act (RLUIPA)
  • Restrictive housing standards and procedures
  • Staff duty to intervene when witnessing inappropriate or excessive force
  • The role of organizational culture, ethical leadership, and supervision in preventing institutional failures
  • Grievance procedures and proper documentation practices
  • Legal frameworks including the Prison Litigation Reform Act (PLRA) and Civil Rights of Institutionalized Persons Act (CRIPA)

Emphasis is placed on understanding how effective grievance management and comprehensive documentation serve as essential tools for detecting and addressing systemic problems before they escalate into litigation.
