Overview:

This comprehensive training program equips law enforcement officers with the knowledge and skills necessary to effectively handle the critical phases that follow an OUI arrest. Since operating under the influence cases represent some of the most heavily contested prosecutions, officers must be thoroughly prepared to justify their investigative actions and testify persuasively in legal proceedings. The course addresses the full spectrum of post-arrest responsibilities, from proper chemical testing procedures to delivering compelling courtroom testimony while maintaining constitutional compliance.

Supported by the Maine Bureau of Highway Safety, this training examines all aspects of impaired driving investigations, including the circumstances of the initial traffic stop, chemical testing protocols, court testimony expectations, and Bureau of Motor Vehicles procedures. Special emphasis is placed on recognizing and investigating drug impairment, with particular attention to cannabis and opioid-related impairment cases.

Course Learning Objectives:

  • Examine legal standards and procedural protocols required at fatal crash investigation scenes
  • Analyze constitutional protections and required procedures for conducting chemical testing following arrest
  • Enhance documentation quality to ensure thorough, clear, and court-appropriate reports
  • Construct and deliver persuasive direct testimony in OUI prosecutions
  • Master cross-examination strategies to maintain credibility and professional demeanor under challenging questioning

Through interactive case discussions and practical mock testimony exercises, participants will develop competency in navigating both direct and cross-examination scenarios with professionalism and confidence.
