Pursuant to state statute, a rail or bus operator is considered a “protected employee”. Due to that classification, an assault upon such a protected individual is an elevated charge to aggravated assault. Due to the nature of these charges and the intricacies of the criminal justice system, NJ TRANSIT Police provides the protected employee with necessary guidance to navigate the court system including court appearances in Municipal Court, Grand Jury and/or trial. Additionally, an individual selected to serve in this position will provide assistance to the NJ TRANSIT Police for coordination with court representatives, outside law enforcement agencies and by the Department as noted in more detail below.

Reporting to NJTPD Director of Intelligence, the duties of the Employee Court Advocate are:

ROLES AND RESPONSIBILITIES:

  • Review the case with the protected employee, discuss and answer questions regarding the court process, receive and manage subpoenas, court notices and pleadings received from the court, docket all relevant dates, maintaining consistent communication with the protected employee and other interested parties before any court dates.
  • Provide transportation and accompany the employee to court, meet with the prosecutor(s) and protect the interest of the employee and NJ Transit. 
  • Meet with the Commanding Officer of each region to keep them abreast of issues concerning Police requests that come from the meetings and provide assistance. 
  • Serve as the liaison between different departments and offices, as well as ensuring people are at court for the times they are supposed to show up and filing paperwork. This can include delivering subpoenas, contacting attorneys' offices in order to set up appointments for clients and can even include keeping track of the official docket as well as to prosecutor’s offices, other federal, state and city law enforcement or investigative agencies regarding the status of investigations of NJT employees and arrange court adjournments or rescheduling that may need to be accomplished. Coordinate with Bus and Rail Management regarding case status.
  • Communicate with Bus and Rail Union representatives, including making presentations at Union meetings.
  • Collect data and maintain records and statistics regarding number, location, times, and types of assaults.
  • Recommend support through Employee Assistance Program (EAP) for protected employees the internal group that provides confidential psychological support and post-incident counseling.
  • Continue to implement the de-escalation mandatory training program created for this role through NJT and available to protected employees to instruct on tactics to handle potentially violent situations, the importance of reporting assaults, and the NJ Transit POLICE response to reports of assault. Develop and deliver any new programs, as may be deemed necessary.
  • Work with Prosecutors (county and local) to ban violators as part of the sentence or plea agreement and to better address assaults against protected employees. 
  • Notify protected employees who reported an incident that the agency has documented the event and is conducting a root cause analysis, regardless of if the violator has been identified. 
  • If necessary, respond to scene and/or hospital, provide case management, assessments, resource navigation, follow-up, and additional supportive services as necessary for protected employee.
  • Make presentations and provide briefings to employees, police executives, transit executives, and outside agencies.
  • Performs other duties, as assigned or needed.

KNOWLEDGE & SKILLS REQUIRED:

  • Bachelor’s Degree in Legal or Justice Studies, Criminal Justice, Public or Business Administration or related area from a US Department of Education accredited college or university, plus three (3) years’ experience in a recognized judicial, legal or law enforcement office/agency is required.
  • A Master’s Degree may be substitute for one year of experience but is not required.
  • A Juris Doctorate may be substituted for three years of experience but is not required. 
  • Knowledge of police and/or court procedures required.
  • Experience with labor unions is recommended, but is not required.
  • Computer knowledge of MS Word, Access, Outlook, Excel and Teams required.
  • Excellent verbal and written communications skills are required to effectively interface with all levels of customers, employees, and officials.
  • Must be able to pass a police background check.
